By installing, accessing, or using the Nativus application, the user confirms that they have read, understood, and fully accepted these Terms and Conditions and the Privacy Policy.

1. Application Description

Nativus is a digital wellbeing and personal development application that provides users with access to:

• Audio meditations
• Affirmations
• Guided breathing exercises
• Personal journaling
• Anxiety self-assessment (GAD-7)

2. Eligibility

The application may be used only by individuals who:

• Are at least 16 years old
• Have legal capacity
• Accept these Terms and the Privacy Policy

By using the application, the user declares on their own responsibility that these conditions are met.

3. User Account

To access all features, the user must create an account using:

• An email address, or
• Apple / Google authentication

The user is solely responsible for:

• Maintaining the confidentiality of login credentials
• All activities performed through their account

Nativus is not liable for unauthorized access resulting from user negligence.

4. Data Stored in the Account

During use of the application, Nativus may store the following data:

• GAD-7 assessment results
• Text journal entries
• User name
• Subscription status

5. Subscriptions and Payments

Nativus offers:

• Free access (limited features)
• Monthly subscription
• Annual subscription

Payments and subscriptions are processed exclusively through:

• Apple App Store
• Google Play Store

Business Payments and Subscriptions via App Store are subject to Apple's Standard End User License Agreement (EULA): apple.com/legal/eula

Nativus does not directly process payments and does not store payment card details.

6. Intellectual Property

All materials available in the application (texts, audio, design, avatar, source code, functional structures) are the exclusive property of SC Nativus SRL and are protected by applicable laws.

Any copying, distribution, or unauthorized use is strictly prohibited without prior written consent.

7. Limitation of Liability

The application is used entirely at the user's own risk.

Nativus shall not be liable for:

• Interpretation of content or AI responses
• Decisions made based on application usage
• Undesired effects or subjective outcomes
• Technical issues or temporary service unavailability

The user acknowledges that the application serves an informational and general wellbeing purpose only, and full responsibility remains with the user.

8. Account Deletion

The user may request account deletion directly from within the application.

Upon deletion:

• Data becomes immediately inaccessible
• Permanent deletion occurs within a maximum of 30 days

Certain data may be temporarily archived in a secure environment with restricted access solely for:

• Legal obligations
• Security purposes
• Fraud prevention
• Defense of legal rights

Such data is not used for analytics or marketing.

9. Governing Law

These Terms and Conditions are governed by the laws of Romania and the European Union.

Terms of Use

The user agrees:

• To use the application strictly for personal purposes
• Not to enter personal data belonging to other individuals
• Not to use the application for illegal activities
• Not to attempt unauthorized access to Nativus systems

Use of the application in situations requiring full attention (e.g., driving or operating machinery) is strictly prohibited.

Nativus reserves the right to suspend or terminate accounts that violate these rules, in accordance with applicable law.
